Case Review The case my team chose is Earls v. Tecumseh Public School Board of Education. The amendment this case was associated with was the Fourth Amendment. A brief explanation of what the Fourth Amendment says is that the government cannot conduct unreasonable searches and/or seizures, and to be searched or seized must be supported by a warrant with probable cause. The plaintiff in this case was Lindsay Earls, who was suing the Tecumseh Public School Board of Education because she believed drug testing of students at her school was a violation of the Fourth Amendment. In the case of Earls v. Board of Education the violation of the Fourth Amendment of the US Constitution was mentioned. The Fourth Amendment of the United States Constitution affirms the “right of the people to the security of their persons, homes, papers, and effects, against unreasonable searches and seizures.” When Lindsay Earls was forced to take a drug test at her school, the school violated her privacy rights. By law, children and teenagers under 18 are required to attend school, so when Lindsay was a minor she had no choice. The school is not a reasonable reason for taking the drug test. Lindsay was an outstanding student who participated in many extracurricular activities such as choir, National Honor Society, marching band, and academic team. Drug tests in schools are not required because they show no improvement for the school, they take money away from the school for every drug test performed, drug tests are not always fair, and drug tests can actually cause emotional trauma to students. The defendant in this case is the Tecumseh Public School Board of Education who claims that... middle of the paper... it's unsanitary. Having someone waiting outside your door, listening to your needs is considered an invasion of privacy. It causes humiliation and can make students nervous and perhaps not be able to free themselves. When students are unable to provide a sample sample, they are given tap water to drink. Tap water contains millions of bacteria, which can be harmful if ingested. When going through the drug testing procedure, a cup is provided so that the sample in the cup is very small and is quite easy to miss or spill due to the size. There is also the problem of losing the cup and urinating on your hands, which leads to the spread of millions of bacteria that can cause illness or harm the health of other students, the only exception is if the urine is sterile. While holding in urine can cause bladder problems.
