In the case NY v. Bernhard Goetz, on December 22, 1984, a Saturday afternoon, Troy Canty, Darryl Cabey, Barry Allen, and James Ramseur boarded an IRT subway express train in the Bronx southbound toward Lower Manhattan. The four young people were traveling together in the rear of the seventh carriage of the train. Defendant Bernhard Goetz boarded the same subway train at 14th Street in Manhattan and sat on a bench near the back of the same train car as the four young men. Goetz had in his possession an unlicensed .38 caliber pistol loaded with five rounds of ammunition in a holster on his waistband (Lender). Leaving the 14th Street station, the train headed toward Chambers Street. The defendant was allegedly approached by two of the youths, presumably Canty and Allen. One of the two young men who approached Goetz, Canty, asked, "Give me five dollars." Goetz responded by standing up and pulling out his unlicensed .38 caliber pistol. He fired four shots hitting each of the four youths and shot one of the youths, Cabey, again. The bullet severed Cabey's spinal cord leaving him paralyzed. The rest of the youths hit by a bullet have fully recovered from the attack. According to the defendant, he was aware that the young men did not possess firearms or pistols, but was afraid based on his experience of being "mutilated". The train conductor, after hearing the shots, ordered the engineer to call for help. When the conductor got into the seventh carriage of the train, where the shooting occurred, he saw Goetz sitting on one of the benches while the four wounded young men were lying on the ground or slumped against a seat. The defendant claimed to the conductor that the four young men had been tried... by document... on March 27, 1985. The indictment included four counts of attempted murder, four counts of first-degree assault, one charge of first-degree reckless endangerment and one charge of second-degree criminal possession of a weapon.
