Topic > Police discretion - 897
Our text states that minors are protected from unreasonable searches and seizures and must be presented with a valid search warrant unless they have waived that right, have consented to a search of their person or property, or have been caught red-handed. If these conditions are not met, the courts will quash the sentences against the minor. The text gives the example of a police stop; a police officer has the right to stop a young person on the street and ask questions, but the minor is not legally obliged to stop or answer any of the officer's questions if he does not want to answer, and can leave if he does not want to.
